OPEN TO U.S. CITIZENS WHO HOLD A VALID PASSPORT AND WHO ARE  RESIDENTS OF THE 50 UNITED STATES and the District of Columbia (EXCLUDING PUERTO RICO, THE U.S. VIRGIN ISLANDS, AND OTHER U.S. COMMONWEALTHS, TERRITORIES AND POSSESSIONS), WHO ARE 21 YEARS OR OLDER AT THE TIME OF ENTRY.

1. HOW TO ENTER:  The “Quantum of Solace Australian Getaway Sweepstakes” (the “Sweepstakes”) is sponsored by BET Interactive, LLC (“Sponsor”), located at 1235 W Street, NE Washington, DC 20018-1211.  Sweepstakes begins at 6:00pm ET Monday, October 20, 2008 and ends at 6:00 pm ET Thursday, November 20, 2008. To enter the Sweepstakes, log on to http://www.bet.com/contests (the “Website”) and complete an entry form as instructed on the Website. None of the Sweepstakes Parties (as defined below) assume any responsibility for any computer, technical, telephone, cable, network, satellite, electronic or Internet hardware or software malfunctions, failures, connections, availability, or garbled or jumbled transmissions, or service provider/Internet/website/use net accessibility or availability, traffic congestion, or unauthorized human intervention. Sponsor reserves the right to suspend or terminate the Sweepstakes in whole or in part by giving notice of suspension or termination, in any form and manner deemed appropriate by Sponsor. Should the Sweepstakes be suspended or terminated as aforesaid, a prize winner will be selected from all eligible entries received prior to (or in the case of temporary suspension, after) the suspension or termination and in accordance with these Official Rules.

2.  ELIGIBILITY: The Sweepstakes is open only to  U.S. CITIZENS WHO HOLD A VALID U.S. PASSPORT and are residents of the 50 United States and the District of Columbia (excluding Puerto Rico, the U.S. Virgin Islands, and other U.S. commonwealths, territories, and possessions, and who are  21 years or older as of the date of entry into the Sweepstakes... Employees, officers and directors of Sponsor, Sponsor’s licensors, prize suppliers and promotional and advertising agencies, and of each of the foregoing entities’ affiliates (collectively, the “Sweepstakes Entities”), and members of such employees’, officers’ or directors’ immediate families (spouses, parents, children, siblings, and their respective spouses) and households are not eligible to enter the Sweepstakes. 

 This Sweepstakes is subject to all federal, state and local laws. Sponsor reserves the right to verify eligibility qualifications of any entrant or winner. By entering, entrants agree to be bound by these Official Rules.  In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes promotional materials and the terms and conditions of the Official Rules, the Official Rules shall control. None of the Sweepstakes Entities shall be responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes or in the announcement of the prize.

3.  CONDITIONS OF ENTRY: An eligible entry must be received via online as described above.  Incomplete entries are void. An eligible entrant may only submit one entry per day, and all entries beyond one per day will be rejected.  By entering, entrants agree to comply with these Official Rules, including all eligibility requirements. The information submitted as part of the entry into the Sweepstakes shall be governed by Sponsor’s privacy policy(http://www.bet.com/privacypolicy) and Terms of Service (http://www.bet.com/site/termsofservice). Entry will be deemed to have been submitted by the authorized account holder of the e-mail address from which the entry is made.  Proof of online submission will not be deemed to be proof of receipt by Sponsor.  Sponsor is not responsible or liable for lost, stolen, mutilated, incomplete, incorrect, delayed, late, interrupted, illegible or misdirected entries.  All entries become the property of Sponsor and will not be acknowledged or returned.

4.  PRIZE: One (1) winner will receive two (2) tickets to the Alicia Keys concert on December 12, 2008 in Sydney, Australia, for the winner and a guest; two (2) round-trip coach class airfares to Sydney from the closest major gateway airport to the winner’s residence, for departure on Monday, December 8 – returning Sunday, December 14; hotel for 4 nights/5 days airport transfer service and per diem ($100 per day) for 5 days.  Hotel (double occupancy) selected by BET.com in its sole discretion.  Total approximate retail value (ARV) of Prize is $13,000.00.   ARV may vary depending on time of booking and place of departure.  Prize does not include meals, gratuities, ground transportation to and from winner’s residence and the airport, or any other expenses not specifically listed herein, and all such shall be the sole responsibility of the winner and his or her guest. Prize has no cash redemption value.  If winner cannot travel on the specified dates, prize will be forfeited and the prize may be awarded to an alternate winner.  Guest must be 21 years of age or older at the time of travel or the winner must be the parent or legal guardian of his or her guest. Winner and guest are each responsible for obtaining all necessary and required travel documents, including, without limitation, necessary passports and visas. Any federal and state taxes on a prize are the sole responsibility of the winner.  No substitution or transfer of the prize is permitted, except at the sole discretion of Sponsor.  If Prize, or any portion of a prize is unavailable, Sponsor reserves the right to substitute that prize or portion of the prize with a prize of equal or greater value. Prize will be awarded, provided it is properly claimed.

5. DETERMINATION OF WINNERS:  Sponsor will conduct selection of winning entry by random drawing under secure conditions. Winner will be selected from among all eligible online entries received by the deadline date of November 20, 2008.  Sponsor will notify potential winner by phone and/or email after the drawing.  If a potential winner cannot be reached after a reasonable effort has been exerted, if he/she is found to be ineligible or if he/she cannot or does not comply with these Official Rules, potential winner will be disqualified and an alternate potential winner will be selected, at Sponsor’s sole discretion.

6.  GENERAL CONDITIONS: Potential winner will be required to sign and return any applicable documents sent by Sponsor related to the Sweepstakes, which may include, but are not limited to a Letter of Prize Acceptance and an Affidavit, Waiver of Liability, Publicity and Travel Release within five (5) days of notification.  Failure to return documents as specified or if prize notification is returned as undeliverable will result in entry being disqualified, and an alternate potential winner being selected.  Where permitted by law and Sponsor’s Privacy Policy, winner agrees to grant to the Sweepstakes Entities the right to print, publish, broadcast and use, worldwide, in any media now known or hereafter developed, including but not limited to the world wide web, at any time or times, the winner’s name, portrait, picture, voice, likeness and biographical information for promotional purposes in connection with the Sweepstakes and for no other purpose.  By entering this Sweepstakes, each entrant agrees to release and hold harmless each of the Sweepstakes Entities and their respective employees¸ officers, directors, and agents from any injury, loss, death, damage, action, claim, demand, liability, cost or expense (including, without limitation, any reasonable outside attorney’s fees) that may occur from entrant’s participation or inability to participate in the Sweepstakes or from the acceptance, use, misuse, or inability to use of any prize awarded, or attendance at any event. Odds of winning depend on the number of eligible entries received.  IN NO EVENT WILL ANY OF THE SWEEPSTAKES ENTITIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT INCIDENTAL, CONSEQUENTAL OR PUNITIVE DAMAGES ARISING OUT OF THIS SWEEPSTAKES OR ANY ENTRANT’S USE OF THE WEBSITE. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THIS SITE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS, OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS, FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.  CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.

Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Sweepstakes or the Website; to be in violation of the Official Rules; or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.  Any use of robotic, automatic, macro, programmed, or like entry methods will void all such entries by such methods.  In the event of a dispute as to entries submitted by multiple users having the same email account, the authorized subscriber of the email account used to enter the Sweepstakes at the actual time of the entry will be deemed to be the participant and must comply with these Official Rules.  Authorized account subscriber is deemed to be the natural person who is assigned an email address by an Internet access provider, online service provider or other organization, which is responsible for assigning email addresses email, addresses or the domain associated with the submitted email address.

7.  DISPUTES: As a condition of participating in the Sweepstakes, entrant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively, before a court located in the State of New York having competent jurisdiction, which court shall apply the laws of the State of New York without regards for doctrines of Conflict of Laws. 

8. WINNERS’ LIST:  For the name of the winner, available after December 4^th, 2008 mail a self-addressed stamped envelope to: “Quantum of Solace – Australian Getaway Sweepstakes”, BET Interactive, LLC, 1540 Broadway 27^th Floor, New York, NY 10036.  Washington and Vermont residents may omit return postage when requesting list of prize winners.
